Lawful Gun Owner and Rebel Patriot Arrested for Brandishing

Police in Virginia Beach arrested an 18-year-old man yesterday and charged him with two misdemeanor counts of brandishing a firearm after he allegedly pointed his gun at elementary school students.

Joshua P. Dalton was in a blue pickup truck at the time of the incident, and was reportedly stopped behind a Pembroke Elementary school bus that was unloading children. Two students returned to the bus and informed the driver that Dalton had pulled a gun out and was aiming it at the bus.

The bus driver brought the children back to the school and alerted the authorities.

According to police, Dalton was upset about disparaging remarks the students made concerning a Confederate flag on his truck.

He was booked into jail and later released on bond. A female passenger in Dalton's truck was not arrested.

  1. Nothing in the source articles says anything about his being a lawful gun owner.

    1. His charge was brandishing, not illegally possessing. That's how we know.

    2. The good news is after plea-bargaining the thing a little bit, this shining example of gun ownership will continue to be one of your number.

And yet, when we have a post where a charge of illegal possession is made, you say: Well, obviously he's still a legal gun owner because the worst he could possibly be is a hidden criminal.

Hey hey! More talking out of your ass about the plea bargaining system, showing your complete disregard for the truth of how the system works.

  2. In this case it's a pretty good assumption Greg. I'm sure they ran his name for warrants and his record when he was booked. If he was for example a felon in possession, he'd likely still be there.
Mike likes to start every posting with "lawful gun owner" or "lawful permit holder" in the hope that occasionally he'll be correct. Possibly he thinks no one will check, which is normal for Baldr and his Walmart blog. But Mike is willing to take comments, which is something Baldr doesn't seem to have the balls for on his blog.

    1. I object to Mikeb's absolute statements based on no evidence. This story is an example of the typical lack of detail that we see in these cases. What kind of gun did this man have? He's eighteen. If it was a handgun, he wasn't allowed to have it in his possession. That's the kind of thing that doesn't get reported--not due to some conspiracy of reporters, but thanks to the constraints of time and probably knowledge. But just because he wasn't charged with being illegally in possession or just because the reporter didn't tell us about that doesn't make this person a lawful gun owner.

    2. Greg,
While you have to be 21 to buy a handgun from an FFL, in Virginia, minimum age for possession is 18. And while the very short article doesn't say, it might still be investigated. Contrary to Mike opinions, I believe law enforcement takes protection of kids seriously. Like I said, I think he just opens up a template that starts with the legal owner claim.

"It shall be unlawful for any person under 18 years of age to knowingly and intentionally possess or transport a handgun or assault firearm anywhere in the Commonwealth."

    3. ss, first you took Greg to task for NOT agreeing that the guy was a lawful gun owner, then you disparaged my saying so. Make up your mind, man.

    4. Umm, that's not "taking Greg to task" but pointing out why you might be right in this case.

As for his comments about you--your post on the Department of Corrections guy in NY shows that you'll call anyone a "lawful gun owner" even if they're charged with unlawful possession. Sorry, but his criticism hits the mark here and doesn't contradict what he told Greg.
